Meta Faces Landmark Trial Over Child Safety Practices

Meta is gearing up for a significant trial that commences on Tuesday, following two prior legal setbacks this year related to child safety issues on its platforms. Jury selection concluded in Oakland, Calif., last week for the federal trial presided over by U.S. District Judge Yvonne Gonzales Rogers. While an eight-person jury will provide a decision, they will serve in an advisory capacity, with the final verdict resting with Judge Rogers alone. The trial is anticipated to span at least six weeks, with Meta CEO Mark Zuckerberg and Instagram head Adam Mosseri potentially summoned as witnesses.

The lawsuit’s origins trace back nearly three years when multiple states, led by officials from various political affiliations, jointly filed a lawsuit in California federal court. The legal action accused Meta, the parent company of Facebook, Messenger, Instagram, and WhatsApp, of breaching federal regulations by gathering data from users under 13 without parental consent. The extensive complaint alleged that Meta employed deceptive tactics to conceal the harmful and addictive nature of its platforms for young users, while profiting from data collection and targeted advertising.

The trial’s starting phase involves four states: California, Colorado, Kentucky, and New Jersey. Additional states may pursue their own legal actions subsequently, although an adverse outcome for Meta in this trial could prompt the company to seek resolution and avoid further costly litigation. The states are seeking unspecified damages, while Meta has disclosed in legal filings a potential financial exposure of up to $1.4 trillion US. Meta asserts that such a substantial penalty would be unprecedented and impractical, potentially leading to insolvency and ownership transfer to the states.

Meta has refuted the allegations, emphasizing its commitment to youth safety and highlighting implemented safety measures since the lawsuit’s initiation. The company introduced enhanced safety protocols, including private teen accounts on Instagram, content restrictions, and AI monitoring to detect underage users. Amidst legal challenges, Meta has faced financial repercussions, including a recent profit decline attributed in part to substantial legal expenses. Previous rulings ordered Meta to pay substantial civil penalties, with calls for platform modifications to enhance user safety measures.

The legal landscape for Meta remains complex, with ongoing litigation in various jurisdictions, including challenges in Tennessee and Canada. The company’s response to these legal battles underscores its dedication to addressing concerns related to platform addiction and youth well-being.
