A tragic incident unfolded as a man passed away due to extreme constipation, with 1.4st of impacted feces obstructing his bowels after he struggled to have a bowel movement for a month.
The family of James Stewart, aged 41, has initiated a lawsuit alleging that his death could have been prevented. They claimed that the staff at the residential facility where James resided failed to heed warning signs, such as a distended abdomen and unusual behavior, leading to his demise on November 15, 2024.
According to the lawsuit, James had not experienced a bowel movement for several weeks to a month before his passing. The legal action was directed against Clear Skies Ahead in Bazetta Township, Ohio.
James was a resident at the facility due to his requirement for constant supervision and support, given his intellectual and/or developmental disabilities and a history of constipation. Medical documents revealed that James had been prescribed medication causing severe digestive complications. His family fondly remembered his passion for music, swimming, and sports events.
Allegations in the lawsuit suggested that the staff disregarded James’ complaints about constipation. They observed his deteriorating health and unusual behavior in the days leading up to his death.
Described as despondent and in pain, James exhibited low energy and complained of discomfort. His abdomen was swollen, and there were signs of bruising on his stomach.
Attorney Matt Mooney, representing the family, highlighted that Clear Skies Ahead staff were aware of James’ chronic constipation issue. He criticized the lack of attention towards James’ bowel movements, emphasizing the negligence of the staff.
On the fateful day, a staff member reportedly instructed James to attempt using the toilet, but he was unsuccessful. Subsequently, James was discovered collapsed in his room and was rushed to a nearby hospital, where he was declared deceased. The Mirror has reached out to Clear Skies Ahead for their response.
