“Qualcomm Faces Legal Action Over Smartphone Prices”

Millions of individuals who previously bought an Apple or Samsung smartphone might receive compensation if a significant legal action taken by Which? against a major tech company proves successful.

The focus of the case is on whether Qualcomm possessed market dominance and, if so, whether it misused its position. Qualcomm is a global tech firm that develops and produces wireless communication products, software, and services.

Which? alleges that Qualcomm overcharged manufacturers like Apple and Samsung for technology licenses, leading to potentially higher prices for customers.

The trial commences today and is set to last for five weeks at the Competition Appeal Tribunal in London. If the initial phase succeeds, a subsequent trial will pursue damages estimated at around £480 million.

Which? suggests that individuals who purchased an Apple or Samsung smartphone between October 1, 2015, and January 9, 2024, may be impacted.

If successful, around 29 million consumers could receive approximately £17 in compensation per phone, with specific models of Apple or Samsung smartphones automatically included in the claim.

It is important to note that there is no guarantee of compensation at this stage; the case must first succeed in the Competition Appeal Tribunal.

Anabel Hoult, the Chief Executive of Which?, stated, “This trial marks a significant moment, demonstrating how consumer power, backed by Which?, can hold major companies accountable for any misuse of their dominant position.”

Without Which?’s collective claim on behalf of millions of affected UK consumers, seeking damages from the company individually would likely be impractical. This underscores the importance of consumers uniting to claim the redress they deserve.

Qualcomm has been approached by the Mirror for comments regarding the matter.
