A man fined £1,000 for improper waste disposal near a recycling bin is determined to continue his fight after successfully reducing the penalty. Lee Reynolds faced the fine for leaving cardboard beside overflowing bins at a Tesco location in New Milton, Hampshire.
The penalty, issued on June 3 by the New Forest District Council (NDFC) for “illegally depositing waste,” left Reynolds feeling upset. Despite NDFC’s claim of frequent bin emptying, photos taken during the incident showed all bins were full.
Reynolds contested the fine, pointing out that the warning sign against waste disposal was obscured by the excessive rubbish. NDFC eventually downgraded his offense from fly-tipping to a “failure to control household waste,” resulting in a reduced £150 fine if paid by July 3. Reynolds complied with the reduced fine but remains dissatisfied.
Expressing his frustration, Reynolds stated that his attempts to appeal and engage with council members were unsuccessful. Feeling compelled by the looming deadline, he reluctantly paid the reduced fine. He emphasized the mental anguish caused by the situation, noting his adherence to the law as a responsible citizen.
Not willing to back down, Reynolds has escalated the matter to the district council’s complaints process. If this avenue proves futile, he intends to file a complaint with the Local Government and Social Care Ombudsman. He highlighted the hazardous waste accumulation near the bins and criticized the council’s failure to maintain cleanliness while penalizing him.
Reynolds claimed that the overflowing bins offered no space for additional cardboard and that he did not see any clear instructions or warnings against placing recycling next to full containers due to the obscured signage.
While the NFDC declined to comment on individual cases, they reiterated that waste disposal next to full containers constitutes fly-tipping, posing environmental risks and incurring additional costs for waste management. The council acknowledged efforts to combat fly-tipping through site renovations and increased signage before the incident.
The NFDC emphasized the importance of responsible waste disposal to prevent environmental harm and additional expenses for waste processing. They noted a rise in fly-tipping incidents at the location and ongoing educational initiatives to address the issue.
