The Yukon Court of Appeal has rejected the appeal of a man seeking to reduce his sentence for sexual assault.
Rudra Amin, now residing in Calgary, was convicted in 2023 of assaulting three women in Whitehorse between 2017 and 2018. The victims reported the incidents in 2020, leading to Amin’s conviction on four counts of sexual assault following a jury trial.
Following his sentencing, Amin promptly lodged an appeal and was subsequently granted release on bail. In his appeal, Amin sought a reduction of two months from his slightly over two-year sentence to qualify for a conditional sentence order, citing concerns over potential immigration repercussions.
However, in a ruling dated August 6, Justice Susan Griffin dismissed the appeal. Griffin refuted Amin’s argument that the initial sentencing judge had committed errors and also deemed the request for a conditional sentence unsuitable.
Griffin emphasized that Amin’s plea to shorten his sentence by two months lacked merit unless there was a fundamental error influencing the sentence. “This is merely minor adjustment and falls outside the scope of this court’s jurisdiction,” read Griffin’s ruling.
Amin is now mandated to serve his original sentence of slightly over two years.
