Investigations have commenced into eight companies due to concerns regarding their online pricing strategies. Additionally, warnings are set to be issued to around 100 other businesses.
Among the companies under scrutiny are StubHub, Viagogo, AA Driving School, BSM Driving School, Gold’s Gym, Wayfair, Appliances Direct, and Marks Electrical.
The Competition and Markets Authority (CMA) is focusing its investigations on the presentation of fees online, potential misleading time-limited offers, and the automatic opt-in of customers for optional charges.
Specifically, StubHub and Viagogo are being probed for additional charges related to ticket purchases. AA Driving School and BSM Driving School are being looked into for how they display fees on their websites, including the timing of fee disclosures during the purchase process.
Gold’s Gym is facing scrutiny for how it presents a one-off joining fee for its annual membership, particularly the timing of introducing this fee during the sign-up process. Wayfair, Marks Electrical, and Appliances Direct are also subjects of investigation for various practices related to time-limited sales, default opt-ins, and fee presentations.
The CMA mentioned that these companies are suspected of breaching consumer law, although no final decisions have been reached yet. These cases mark the first instances where the CMA is leveraging its new consumer protection powers. The CMA is also reaching out to 100 businesses to address concerns about their use of additional fees and sales tactics.
Sarah Cardell, the CEO of CMA, emphasized the importance of consumers being able to shop online confidently, ensuring transparency in pricing and genuine sales. She reiterated the commitment to safeguard consumers from misleading practices and enforce fair dealings, emphasizing the agency’s dedication to upholding consumer rights and business integrity.
Representatives from AA Driving School and Viagogo have expressed willingness to cooperate with the investigations. The Mirror has reached out to Gold’s Gym, Wayfair, Marks Electrical, and Appliances Direct for comments. BSM Driving School is under the ownership of the AA, while Viagogo and StubHub share the same parent company.
