It was later revealed by Square, the payment processing platform used by the farm, that all transactions with the caterers were fraudulent, leaving the family accountable for reimbursing the platform for the significant loss.
Alana Cosgrove, the co-owner of Pengrove Farms, described the situation as a critical financial setback, emphasizing the challenges of sustaining their business amidst such a loss. Despite being defrauded, the family still faces the obligation to pay their suppliers to continue their operations.
The scam targeted the farm by building a false sense of trust, with the fraudsters establishing a rapport by engaging in friendly conversations, visiting in person to collect orders, and creating a facade of legitimacy. According to Andréanne Bergeron, an expert in criminology, this type of fraud preys on trust and psychological mechanisms, exploiting the vulnerability of businesses once an initial payment is received.
In Quebec, payment platforms lack the regulation seen in banks or insurance companies, placing the burden of chargeback liability on merchants like Pengrove Farms. Frédérique Lissoir, an expert in business law, highlighted the lack of protections for businesses under current Quebec laws, contrasting with other jurisdictions that have implemented measures to safeguard businesses from fraudulent activities.
While Square acknowledged the challenges faced by small businesses targeted by fraudsters, the responsibility for losses often falls on the merchants due to the absence of comprehensive protections. The family is now advocating for policy changes to enhance safeguards for businesses and prevent similar incidents in the future.
Despite the setback, Pengrove Farms has received overwhelming support from the community through initiatives like a GoFundMe campaign and local market sales, demonstrating resilience and determination to overcome the adversity they faced.
